Please read the following important terms and conditions before you buy anything on our website and check that they contain everything which you want and nothing that you are not willing to agree to.

This Contract sets out:

 

your legal rights and responsibilities;

our legal rights and responsibilities; and

certain key information required by law.

Terms and Conditions Definitions

“We”, “our” and “us” – Axe Junkies Limited, a company registered in England and Wales under company number 12397831, having our registered office at 81 McIntyre Road, Worcester, England, WR2 5LQ, and subsequent Franchises of Axe Junkies Ltd.

“You” and “Customer” – The individual who has made the booking on behalf of themselves or their party.

“Group”, “Party” and “Event” – All the customers within your group.

“Venue” and “Site” – The location of Axe Junkies Ltd or Event for which you have made a booking for our mobile services.

“Booking Confirmation” – Details of your booking and associated terms with pricing and payment information.

“Contract” – Booking Confirmation and these terms and conditions between you and the relevant Franchise Limited Company of Axe Junkies Ltd

“Static Site” – Provision of services at one of our Venues, which requires your attendance at the Venue.

“Mobile Site” – Provision of services at a location to be determined by you.

 

  1. Introduction

 

If you making a booking with us you agree to be legally bound by this Contract. When buying any services you also agree to be legally bound by:

 

our website terms and conditions of use and any documents referred to in them;

the summary of this Contract;

the waiver that you will be required to sign; and

any extra terms which may add to, or replace some of, this Contract. This may happen for security, legal or regulatory reasons. We will contact you to let you know if we intend to do this by giving you one month’s notice.

All of the above documents form part of this Contract as though set out in full here.

 

It is assumed that you are the main point of contact for your group and that all correspondence will take place between you and us. It is your responsibility to relay the necessary information to all members of your party.

 

These conditions shall form the basis of the Contract for your booking and shall apply to the exclusion of any other terms and conditions whether put forward by you, your group or a third party or whether implied by law. No alteration to these conditions shall be effective unless expressly agreed to in writing by a director of Axe Junkies Ltd.

 

This Contract applies to both Static Venue and Mobile bookings.

 

  1. Information we give you

 

By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that we must give you certain key information before a legally binding contract between you and us is made. If you want to see this key information, please:

read the Booking Confirmation; or

contact us using the contact details at the top of this page.

The key information we give you by law forms part of this Contract (as though it is set out in full here).

 

If we have to change any key information once a legally binding contract between you and us is made, we can only do this if you agree to it.

 

  1. Bookings, Cancelations and Refunds Policy

 

When you make a booking, please read and check your booking carefully before submitting it. After a booking has been made you will be sent a Booking Confirmation with details of your booking session including payment confirmation, date of the Event, number of participants, payment and all other details relevant to the booking. It is your responsibility to check that the details on the Booking Confirmation are correct and you must advise Axe Junkies Ltd of any inaccuracies within 24 hours of making the booking.

 

We may contact you to say that we do not accept your booking. This is typically for the following reasons:

 

we cannot carry out the booking (this may be because, for example, we have a shortage of staff);

we cannot authorise your payment;

you are not allowed to buy the services from us;

we are not allowed to sell the services to you; or

there has been a mistake on the pricing or description of the services.

We will only accept your booking when we email you to confirm this. At this point:

 

a legally binding contract will be in place between you and us; and

we will provide the services as agreed during the online booking process.

Upon confirmation of your booking you will receive a booking reference number. In making a booking with us, acceptance of this Contract is understood and in the case of group bookings, that the person making the booking is responsible for making all members of his or her group aware of this Contract.

Immediate and full payment is required at the time of booking. If payment is not received Axe Junkies Ltd reserve the right to cancel your booking.

Once a booking has been made a confirmation email containing details of your booking event including payment confirmation, dates of the event, number of participants, payment and all other details relevant to the booking. It is your responsibility to check that the details on the confirmation are correct and you must advise Axe Junkies Ltd of any inaccuracies within 24 hours of making the booking.

Axe Junkies Ltd offer a full refund up to 7 days of your booking. To cancel or change a booking please contact us at [email protected].

Axe Junkies Ltd are unfortunately unable to offer refunds for any sessions which are cancelled after this 7 day period. Due to the nature of the business when bookings are confirmed and paid for after the cancellation period has expired Axe Junkies Ltd immediately incurs expenses and costs directly relating to your booking whilst we prepare for your arrival.

Bookings after this period are non-transferable, except at the complete discretion of Axe Junkies Ltd. Only in extenuating circumstances will bookings be considered for transfer and a request is given via email.

Axe Junkies Ltd reserves the right to transfer your booking date and/or time due to operational or unforeseen circumstances. If we are unable to transfer your booking to an alternative date and/or time, we reserve the right, in our absolute discretion, and with or without prior notice, to cancel your session.

The time, date and location of your booking cannot be altered, however if you require an alteration, please contact us and we will do our best to accommodate you. Once a booking has been made, amendments can only be made with prior agreement from us.

We reserve the right to cancel your booking with full refund in the unlikely event that we are unable to complete your booking and which cannot be transferred to another date and/or time, but otherwise shall have no liability whatsoever, including, but not limited to, liability for travel expenses or any other out of pocket expenses, in respect of the cancellation.

 

In the unlikely event that our terms and/or availability for your group changes after your booking is confirmed, we will do our best to ensure that your Event is rescheduled. If we are unable to make an alternative arrangement to your booking you will be given a full refund for that part of your booking. Alternatively, gift vouchers can be offered to the equivalent value of your booking.

In any event, we shall not be liable for any delays or any failure to perform any of our obligations under this Contract, caused by any event outside our control, including but not limited to, a global pandemic, acts of terrorism, natural disasters, poor weather conditions and the declaration of war.

 

If an event outside our control takes place that affects the performance of our obligations under this Contract:

we will contact you as soon as reasonably possible to notify you; and

our obligations under this Contract will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control. Where the event outside our control affects our performance of your booking, we will restart the booking as soon as reasonably possible after the event outside our control is over.

We will only cancel this Contract if the event outside our control continues for longer than 4 weeks and we agree that your booking cannot go ahead. In this case, we will refund you the amount paid for your booking, minus the reservation deposit which is non-refundable.

 

Gift Certificates are not refundable after purchase and can only redeemed through Axe Junkies Ltd booking system at axejunkies.co.uk. Once purchased, Gift Vouchers must be used within 12 months. Expiry dates cannot be extended except at the discretion of Axe Junkies Ltd.

 

Promotional codes and discounts must be used at the time of booking through the booking system. The stated promotion will then be applied to your booking. Promotions cannot be applied to bookings after they are purchased. Unless stated otherwise, discounts cannot be combined or used in conjunction with any other offer. Promotional codes cannot be applied to the purchase Gift Vouchers.

 

  1. Restrictions

 

Each customer is responsible to determine if they are fit to safely take part in axe throwing. Axe Junkies Ltd is not qualified to determine this, however we can advise on the physical requirements of the activity. Please seek medical advice prior to your session to ensure you are physically fit enough to participate.

 

The following persons are not allowed to participate in any games:

 

anyone who appears intoxicated through alcohol, drugs or any other intoxicating substance;

anyone who has had an operation within the past 12 months that, through participating, the object of the operation could be aggravated;

anyone undergoing medical treatment for an ailment that may be aggravated, including but not limited to, high blood pressure, epilepsy, back problems, neck problems or any heart condition; or

anyone suffering from any other known condition that may be aggravated.

For all bookings, a qualified first aider must be present at the Site at all times.

 

We reserve the right to refuse play on the day of your event without refund if you or any of your party are deemed by our staff to be physically unfit to play due to injury, illness, or any other condition which we believe is unsafe. Please contact us in advance if you have any concerns about the health or fitness of any member of your group.

 

Players must be aged 10 years or older. We reserve the right to refuse players who do not meet these requirements, without refund. Anyone under the age of 18 is required to be accompanied by a responsible adult at all times when engaging in any Axe Junkies Ltd event. The responsible adult must sign and confirm that they will take reasonability for the agreed under 18 at all times whilst in the Venue.

 

  1. Price Changes

 

All prices quoted by us are accurate at the time of booking. We reserve the right to demand extra payment for any additional charges owing to a change in booking once it has been confirmed to reflect extra costs incurred in transfers, group booking costs and administration.

 

  1. Arrival at the Venue

All players should arrive at their booked Axe Junkies Ltd venue no less than 10 minutes prior to the playing time.

Please be aware if you miss your scheduled start time you will not be eligible for a later booking or refund. If you are not present upon check-in for your pre-booked time our team will endeavour to contact you, please ensure you provide us with a mobile telephone number that your group leader will have with them on the booking day.

Axe Junkies Ltd will prioritise all customers against their booking times and never allow late running customers to have an impact on later start times. Axe Junkies Ltd is not responsible for factors out of its control, for example; late running commuter services, traffic or parking difficulties (this is not an exhaustive list).

 

 

  1. Health & Safety

 

The safety of all our customers and teams is paramount to us. Your party must comply with all instructions given relating to your Event from a member of the Axe Junkies Ltd team. We will take sufficient steps to ensure so far as is reasonably practicable, that your session will at all times be safe and without risk to health. As a result, you will be asked to sign disclaimer forms prior to commencement of your Event. Customers must wear appropriate clothing including closed toe shoes to participate. Participation may be refused if suitable clothing and footwear is not worn.

 

  1. Behaviour

When visiting Axe Junkies Ltd You are expected to respect your environment and other people around you throughout the duration of your event. All venues and/or services have every right to terminate, without notice, your activity under threat of vandalism, violence, abusive behaviour, discrimination or any other behaviour deemed inappropriate by them. In such cases all insurances will be invalidated and you will not have any entitlement to a refund of any kind whatsoever. We accept no liability for any accident or misadventure that occurs while any of your group is under the influence of drink, drugs or other intoxication substances. We reserve the right to disallow play on the day of your event with no refund if you or any of your party are believed to be under the influence of alcohol, drugs or other intoxicating substance. We accept no liability for any damage caused by any member of your group and will provide your contact details to any venue or service

 

We reserve the right to stop play and terminate your session with no refund if you or any of your party do not follow instructions from any member of the Axe Junkies Ltd team. We accept no liability for any damage caused by any member of your group and may seek to claim compensation as a result of your actions.

We reserve the right to stop your session without a refund if we feel that the safety of anyone is at risk.

 

  1. Data Protection

 

Our privacy policy is available at www.axejunkies.co.uk

 

Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our privacy policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

 

If you are attending a Venue, CCTV is in constant use throughout the Venue to ensure the safety of everyone. CCTV evidence will be used to where necessary to support any incidents and will be kept for a minimum of 31 days.

 

  1. Photography & Video

 

When making a booking with us, you agree that all images and videos taken of you and your group are the exclusive property of Axe Junkies Ltd and may be used for promotional activities online and in print. If you do not wish us to use these images and videos, please notify us before the day of your Event.

 

  1. Limit on our responsibility to you

 

Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:

 

losses that were not foreseeable to you and us when this Contract was formed and were not caused by any breach on our part;

business losses; and

losses to non-consumers.

  1. Disputes

 

We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with:

 

the services;

our service to you generally; or

any other matter,

Please contact us as soon as possible.

 

If we cannot resolve a dispute using our internal complaint handling procedure, we will:

let you know that we cannot settle the dispute with you; and

give you certain information required by law about our alternative dispute resolution provider. You may also use the online dispute resolution (ODR) platform to resolve the dispute with us. For more details, please visit the website on the ‘Your Europe’ portal: https://webgate.ec.europa.eu/odr.

If you want to take court proceedings, the courts of the part of the United Kingdom in which you live will have non-exclusive jurisdiction in relation to this Contract.

This Contract is in place to ensure the smooth running and enjoyment of your Event. It is governed by English Law.

 

  1. General

 

The following general conditions shall apply:

This Contract is personal to you and your group. You or your group shall not assign, transfer or charge your rights and responsibilities under these conditions or any of them, without our prior written consent.

The provisions of this Contract are severable and distinct from one another and, if at any time any of the provisions is or becomes invalid, illegal or unenforceable, the validity, legality or enforceability of the other provisions shall not in any way be affected or impaired.

The headings in this Contract are for convenience only and do not affect the interpretation of this Contract.

For the avoidance of doubt, nothing in these conditions shall confer on any third party any benefit or the right to enforce any provision of this Contract.

If we fail to insist that you perform any of your obligations under this Contract, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

We reserve the right to make changes to this Contract as necessary.
